Rental Terms & Conditions

1. Parties & Scope

Castelier (“the Platform”) is operated by Mobemos Hub SL (trading as Castelier Mobility), Marbella, Málaga, Spain — contact castelier@mobemos.com. The Platform technology is owned and provided by Organiq Sweden AB; Organiq is not a party to any rental agreement and has no contractual relationship with customers.

Who you rent from depends on the vehicle. Castelier lists two categories of vehicle:

(a) Castelier vehicles — owned and rented directly by Mobemos Hub SL, which is the lessor and your contractual counterparty.

(b) Supplier vehicles — owned and rented by independent third-party operators. For these vehicles, Mobemos Hub SL acts solely as an intermediary that introduces you to the operator and facilitates the booking in exchange for a commission. The rental agreement is concluded directly between you and the operator, who is the lessor and bears full responsibility for the vehicle, its condition, insurance, and legal obligations.

The identity of the lessor for your specific booking is shown in your booking confirmation. By completing a booking you accept these terms in respect of the applicable lessor.

2. Driver Requirements

The minimum driver age applies per vehicle and is shown on each vehicle’s booking page (typically 21–25, depending on category). Drivers below 25 may be subject to a young-driver surcharge where indicated.

All drivers must hold a valid driving licence held for at least 12 months. For non-EU/EEA licences, an International Driving Permit may be required.

At handover, the driver must present a valid driving licence, a passport or national ID, and a payment card in the main driver’s name. Additional drivers must be declared and registered before driving.

3. Booking & Payment

Rental charges are paid online at the time of booking via our payment processor, Stripe. A booking is confirmed once payment is successfully processed and you receive a confirmation email.

Identity and document verification (KYC) is completed at or before handover. The lessor reserves the right to refuse handover if the driver does not meet the requirements in Section 2 or fails verification, in which case the cancellation and refund terms in Section 7 apply.

4. Security Deposit

In addition to the rental price, a security deposit (fianza) is required. The deposit is taken as a pre-authorisation (hold) on your payment card at or shortly before handover — it is blocked, not charged, and reduces your available card limit for the duration of the rental.

The deposit amount is shown on the vehicle’s booking page and in your confirmation. It covers the applicable insurance excess and any additional charges that may arise during the rental (for example, fuel, late return, traffic penalties, or damage not covered by the selected protection).

The deposit hold is released after the vehicle is returned and inspected, subject to any deductions for charges incurred. Release timing depends on your bank.

5. Protection & Excess

Third-party liability insurance is included by law with every rental. Optional protection packages reduce the damage excess you would otherwise be liable for:

Basic: third-party liability and damage coverage, full deposit/excess applies.

Premium: reduced excess (partial waiver), plus glass and tyre cover and roadside assistance.

All-Inclusive: zero excess, full damage coverage.

Exclusions may apply (for example, interior damage, gross negligence, unauthorised drivers, or breach of these terms). The applicable excess and exclusions are shown at booking and in the rental agreement.

6. Delivery & Collection Zones

Delivery and collection are offered within defined zones:

Zone 1 (Marbella, Golden Mile, Puerto Banús, San Pedro, Elviria and surrounding areas): complimentary.

Zone 2 (Estepona, Mijas Costa, Fuengirola): a delivery fee applies unless otherwise indicated for the vehicle.

Zone 3 (Málaga, Sotogrande, Gibraltar, Nerja and beyond): on request.

Delivery details, including any applicable fee, are confirmed at checkout. The vehicle must be available for collection at the agreed location and time at the end of the rental.

7. Cancellation & No-Show

Cancellation terms depend on the rate selected at booking. Standard rate: cancellation is free up to 72 hours before the agreed handover; cancellations within 72 hours, and no-shows, may be subject to a retention as set out at booking.

Where a Flexible rate is selected, modification or cancellation is permitted up to 24 hours before handover under the conditions shown at booking. Refunds, where due, are processed to the original payment method.

8. Vehicle Condition & Damage Evidence

The vehicle is delivered in documented condition. At handover and return, the vehicle’s condition is recorded photographically. These photographs are stored with a cryptographic integrity record (SHA-256) and form a tamper-evident evidence chain used to fairly resolve any dispute over damage.

The renter is responsible for the vehicle during the rental period and must report any damage or incident immediately using the damage-report link provided with the booking. Damage assessment is based on the documented condition at handover versus return.

9. Fuel Policy

Vehicles are supplied full-to-full: delivered with a full tank and to be returned with a full tank. A refuelling charge plus a service fee applies if the vehicle is returned with less fuel than at handover.

10. Use of the Vehicle

The vehicle must be driven in compliance with the Spanish Highway Code and all applicable traffic and parking rules. The vehicle may not be taken outside Spain without prior written authorisation from the lessor, used to transport dangerous goods, sub-let, used for any unlawful purpose, or driven by any person not registered on the rental agreement.

Traffic fines and penalties incurred during the rental are the renter’s responsibility. Where an authority requests identification of the driver, the lessor will provide the renter’s details as required by law, and an administrative handling fee may apply.

11. Legal Registration (RD 933/2021 — SES)

Under implementation. The automated SES reporting integration is being built and must be active before live rentals commence. This section describes the legal obligation as it will apply.

Spanish law (Real Decreto 933/2021) requires vehicle rental operators to register and report certain renter and vehicle data to the Ministry of the Interior (Dirección General de la Policía) via the SES.HOSPEDAJES platform, within 24 hours of the booking and at the start and end of the rental.

This legal obligation rests with the lessor of each vehicle — Mobemos Hub SL for Castelier vehicles, and the relevant third-party operator for supplier vehicles. Reported data (name, document type and number, nationality, date of birth, address, and vehicle details) is retained as required by law (three years) and handled in accordance with our Privacy Policy.

12. Liability

The lessor is liable only for obligations arising under the rental agreement and applicable law. As intermediary for supplier vehicles, Mobemos Hub SL is not liable for the condition, roadworthiness, insurance, or performance of vehicles owned by third-party operators; such liability rests with the operator as lessor. Nothing in these terms excludes liability that cannot be excluded under Spanish consumer law.

13. Data Protection

Personal data is processed in accordance with our Privacy Policy, Regulation (EU) 2016/679 (GDPR), and Spain’s Ley Orgánica 3/2018 (LOPDGDD).

14. Governing Law & Jurisdiction

These terms are governed by Spanish law. Disputes are subject to the competent courts of Spain, without prejudice to any mandatory consumer protections available to you under the law of your country of residence.
